Er no, what this cunt of a dealer has done is commit fraud! and yet still persist with the fucking outright audacity.

Its far worse than that Mike and what they have done carries some very serious penalties for the dealer concerned. The Consumer Rights Act 2015 is very clear -
  • The goods must be fit for purpose (i.e the bike must be roadworthy and ride-able unless described otherwise)
  • The goods must match the description given at the time of purchase
They did not inform goldfazer that non-standard headers were fitted, they instead deliberately mislead him - this breaches both of the above rules so Gold you have several options -
  • If you bought a product less than 30 days ago is unfit for purpose, faulty or not as described, you have the right to return the product and receive a full refund.
  • If a fault is discovered after the first 30 days but within 6 months of the date of purchase, the fault is presumed to have been there at purchase. It is for the retailer to prove that this was not the case, and not for you to try to prove that it was -
  • You will be entitled to a full refund if repair or replacement is not possible, or is unsuccessful. You have to give the dealership a reasonable opportunity to try to fix the fault. However if they have tried to repair the vehicle more than once unsuccessfully, this requirement will have been fulfilled.
If it has been over 30 days since you purchased the product, you can choose for the retailer to either:
  • Repair the product, or Replace the product.
  • The retailer may however refuse if they can show that your choice is disproportionately expensive compared to the alternative - this would be very hard for them because I have found a complete exhaust system on ebay with the exup for £250 - but common sense you check with the seller that the exup is not seized and moving freely (turning with bare ringers freely).
  • If a fault is discovered over 6 months after the date of purchase, it will be for you to prove that the fault was there at the time of purchase. It is likely that an expert report would be needed to prove this - any yamaha dealer can write a letter stating what exhaust system the FZS1000 is supposed to come with.
Gold what is the name of this dealer so we can all avoid these cunts! as I would happy ride over there on my FZS1000 and visit them with you and your wife to lay the fucking law down and show them what should be fitted to said bike.
