It will run OK with the Delkevic headers but not as it should and no amount of tuning will fix that. The only aftermarket headers designed and proven to retain the scavenging characteristics of the OE EXUP system were made by Muzzy in the USA. These are no longer in production. All the others available, including Akrapovic, soften the power delivery below 4k rpm and in the worst cases, create a flatspot in that region which can't be tuned out via carb mods or anything else.
Technically, I think you'd have a hard time getting a satisfactory outcome through legal action because the bike does run 'OK' with the headers fitted when you bought it. Good luck, though.
