Glad you got it sorted!
I'd just be straight with the dealer and say that the bike was restricted and how could he have not noticed that if it'd had the proper checks like a test ride etc to make sure it was all ok and the fact that if he didn't check or change the air filter what did he do for the "service". Going in and being smarmy or threatening him with trading standards will immediately get his back up and you'll get nothing from him.
