Speak with the dealer first, see if they can shed some light on anything.
A few people on here before have said their restricted bikes normally max out around 8000rpm, so the fact you're hitting 10,000rpm sounds unusual, unless there are different types of restrictor kits, i'm not too sure?
An air leak can cause hesitation problems with overtaking but i'd have thought you'd have had problems in any gear?
It should certainly go way up around the 12000rpm if it's unrestricted though without any issues, so it's definitely one for the shop to deal with either way i reckon.
