Caught speeding but actual speed not listed on form

I was caught near Tyndrum, Scotland on Tuesday night - was stopped doing 80 in a 60  :o

Only thing was they didn't write the actual speed on the ticket - it just says "Ride at  mph in 60mph limit".

Now could I make things worse by fighting it or just take it on the chin...? Licence is was clean so no big deal to have 3 points unless it's a clear invalid ticket and a no-brainer to contest!

Anyone got experience of incorrectly filled out tickets (especially in Scotland)?

Not sure if rules are slightly different in Scotland but a fair few years ago any minor discretions on tickets can't be used as a loophole in order to get out of something!

I recently had to research this for a friend and afaik it is only on a motorway that the police can issue a ticket without needing to declare or have proof of your actual speed, their observations that you are in excess of 70 is enough for prosecution in court.

Now, I am not sure how this would work on a duel carriageway or major road with a limit of 60.
Your best bet is to visit citizens advice!

I assume you have been offered a fixed penalty? If you do not accept it then it will most likely go to court where fines will be higher than the £100 fixed penalty. To contest it in court you would have to plead not guilty.

Just for info - was this on the Crianlarich side of Tyndrum?

I got done a month or so ago coming from Oban to the green welly stop got me just before the junction and pulled us in at the green welly
Bikers there said they had got a few in the hour they had been there and the woman in the petrol station told us they hide in the trees.

Couple years back i seen them hiding by a clump of trees just after green welly on the Oban road therewas a clump on the right hand side and they were in there.......there was a suspect all black bike plus black leather clad biker then followed us from green welly on way home & he was riding suspiciously plodish.....not long after a jam sandwich so not sure if the 2 of them were communicating.......i overtook the jam sandwich, all the while watching my speedo but i had to speed to get passed them, didnt get pulled though

as for the opening question, I'd seek further advice before pleading guilty, try asking a traffic cop you never know....he may just tell you its your lucky day

Where exactly did you get caught and by what? Once I get my bike back on the road I will be going up that way regularly and would like to know where the speed traps are. I heard folk were getting caught between Crianlarich and Tyndrum.

A friend was given a N.I.P. for speeding,no seat belt, on his phone and smoking in his place of work. There was a discrepancy with the timings and a solicitor got him off. Admittedly his bill was £350 but was well worth it.

if the paperwork isn't correct, then it can't be used as evidence.
many moons ago i was caught exceeding the posted limit by a considerable sum (+33).
i was duly summoned to appear before the magistrates expecting to have to plead for my license.
i had a quick word with the duty solicitor who noticed that the speed limit was wrong on the charge sheet and advised me to plead not guilty and to kick up a stink if they try to change the charge there and then.
i pleaded NG to the charge on the sheet, objected to a change of charge and walked out of court with costs against the court.
i also got my godson off a £60 fpn as the officer ticked the wrong vehicle type on the ticket.
sometimes the law works in your favour if you hve the cajones to see it through.

I got caught speeding in the car in Glasgow last December. On the fixed penalty ticket the cop had forgot to put the number of endorsement points on the slip. When I went to court to pay the fine the clerk noticed the error and said she would need to email police Scotland directly about it, and it was likely it would void the ticket.

Couple of weeks later I got a letter from police Scotland to say they now consider the matter closed - no points. No fine. Nothing.

Definitely worth an ask I say.

Got a parking ticket in Camden once, they sent the fine to my house but the number plate was one digit incorrect, so I just ignored it and it went away.

Done that road last wknd heading from Oban to green welly and there was a money making van about 1 or 2 miles from the green welly, but never saw any cops till we got down to Arrochar and they were all in cars too.

It was on the A85 from Inverary via Dalmally to Tyndrum just where it runs alongside the railway line at Arrivain. I was flashed by a car just before the straight so I did already suspect something was up hence not being on full "make progress" mode  :evil

It was a marked up BMW 5 series. I asked them where they got me and they admitted to being up a side road - they said it's a common place for them to sit - FFS! I did see the lights from WAY back - it took them a fair amount of time to catch up as there were a few cars to get past  and the thought of getting the head down and going for it to get away was there - but common sense took over!!

I don't have the cahones to ignore it - or have the desire to take it to court as I can take 3 points no hassle as my licence is clean but rather than just posting it away I'm going to go into the Sherrif Court tomorrow morning and ask the clerk there as per mickvp's comments - definitely worth a shot. If it works I defo owe you some beers mate!

Well apart from the getting caught bit as that didn't happen to me

Two of us  got done 3 years ago on the Cairnryan road heading for the ferry, 80+ in a 60, I will have a look at the ticket but I am sure all it said was, offence SP30. I think we would have just got a caution until my mate opened his big Gob and asked the WPC did she not have time in the morning to get a shave.
I did not contest it just paid and asked them to send my licence back asap as I was going on a touring holiday through France later on in the month. £60 +3 points.
Licence back in a week and also they hoped I would enjoy my holiday.

Well I tried but no joy. Went into court this morning and asked the clerk about it. She phoned up Oban police station and they confirmed the top copy of the ticket showed 81 - it just hadn't copied through. They would use the top copy if it went to court so no case - have to take it on the chin sadly!

I would say that's wrong tbh unless they have given you evidence who's to say they didn't just right it after when they realised their mistake? That's like me saying one thing and you saying another, one word against another with no HARD EVIDENCE to prove different, I'd certainly push for it, clean license or not, it's their incompetence of doing their job. :rolleyes
I can still do that call if you want me to.
