This is a subjective subject to a large extent. Back in the day there was cans stamped as mentioned this can/does still happen, that said many newer (last 15yrs or so) have removal baffles, i.e. when the baffle/s is removed it's not road compliant. What still further complicates matters is the final say it down to the MOT tester ears :rolleyes .
