You need to check your with your insurer do you have Uninsured Loss Recovery (ULR) aka Legal expenses - this will cover recovery of your excess. If you use your insurance, they will ask you to pay your excess which will be deducted from the payment to repair or replace your bike. They can recover that from the 4rd party if you have ULR.
If you do not have it you always can do the claim yourself or get no win no fee motorcycle accident solicitor to do that for you.
