Ask for your money back, as the bike has been wrongly advertised and you have been mis sold information regarding the bike. Tell him if he won't give you your money back that it won't look good from his point of view as several people have looked at his ad on this forum and if he doesn't give you the full deposit back it will not be favourable to his business. 
If it's broken, it's not fixed.
