Bike failed its MOT!

As it's a European bike some of the beam is facing slightly to the right (kerb illumination) which could potentially dazzle oncoming traffic in the UK.  Putting a bit of tape across the appropriate part of the glass cuts out this section whilst still giving enough light to see the road by. 
Some MOT places don't mind, some do but apparently VOSA are getting stricter on this which may be the reason for the previous passes.

So it's effectively still aiming the wrong way, even though the "blinding" part has been cut off?
Surely that must make the lights even weaker than they already are?
I'm amazed a tester would even consider doing that, let alone actually passing it afterwards?
I don't think i could put up with that, i'd personally have to get the light unit changed.
