Right, so he's just given prima facie evidence that the driver was in control of an un-roadworthy vehicle since the MoT test requires that "Fuel cap fastens and seals securely."
In other words he should have gone to the dealer in *another* vehicle, got a cap and *then* put in on the lorry before moving it!
