I havent actually taken apart the rear light assembly so I have no idea if what im about to say next is even relevant, BUT...
Most vehicles ive seen this happen to is a result of a connection coming loose (obviously not the power). The result is a safety measure I guess, they assume that having the break lights on permenantly is better than having them off permenantly
In any case, I could very well be wrong but its possibly somewhere to look if it doesnt go away.
