Crash!

Soooo an unfortunate fello decided to cut through from the opposite side of the road and cross two lanes to get to a garage without checking for traffic from his left, ie me! Needless to say I had nowhere to go and seconds to try and slow myself down to at least soften the unavoidable impact... Thankfully everyone is ok, he is responsible  and extremely shocked and apologetic, and I'm currently awaiting contact from his insurance for the repairs. The plus side is I get new fairing/mirrors etc possibly helmet and boots as well. We shall see. T

At least your ok, don't wait for his insurers to contact you. Contact them yourself to make sure the other guy has informed them off the accident.

Yep spoke to the manager of the company who owns the vans and they have been very cooperative and have informed their insurance as I have mine so the insurance company's should sort it out thenselves and then send me the relevant forms for more details etc, il chase it if I haven't heard anything in a day or so, but thank you Smile

You need to check your with your insurer do you have Uninsured Loss Recovery (ULR) aka Legal expenses - this will cover recovery of your excess. If you use your insurance, they will ask you to pay your excess which will be deducted from the payment to repair or replace your bike. They can recover that from the 4rd party if you have ULR.

If you do not have it you always can do the claim yourself or get no win no fee motorcycle accident solicitor to do that for you.

Go for new leathers as well, if they inquire why the should be replaced The response is 'I've shat in mine........'

When I was knocked off the lad asked if I was OK to which I replied, 'Yeah fine, why not get your dog out of the car and let it bite me too'

:agree You sure your gloves, trousers, jacket weren't damaged - they must have hit the deck  :rolleyes

I had a claim against someone else once when my bike was parked ontop of by a car whilst parked up...


i wasn't on my bike at the time, my insurance company where pushing me to try and get my helmet and leathers replaced too...


i was also asked quite a few times if i had an injuries.  :rolleyes :rolleyes

Somebody tried to kill me in my car a couple of years ago. Would have succeeded if I was on the bike. I was able to claim for everything that was damaged, including all of my CDs that were trodden on when they cut the roof off, even my underpants from when they cut my clothes off! Just remember though, the more that is claimed the more everybodys insurance goes up next year to recover the costs of false claims. Some people take it a little too far. Did that salmon that you had in your back pack get damaged? Wink
Glad you are ok though, never nice to hear of these things.
People who think they know everything are a great annoyance to those of us who do.

IME they do not contact you directly at all unless you handle the claim yourself. They contact whoever handle the claim you've said your insurance company legal department will do that for you? It can take months to handle all claim details.

However claim handling must not stop your insurance comapny to give you replacement bike immediately if it is recognized that the fault is 100% to the 3rd party. Replacement bike must be like for like. Means if your bike is fireblade they cannot give you replacement bike old cb500.

Call your insurance and ask them where is your replacement bike? The answer is pretty good indicator how good are your insurers. If they are no good you can get some motorcycle solicitor to handle your claim.

They also can reimburse you any money for gear and will handle the bike fix, before they get any money from 3rd party insurance company.

Val, you're making an assumption he's got fully comp insurance, if he's tpft then his insurance won't do anything for him.

Phone his insurance company, constantly!
Request a hire bike- immediately- this costs them money, they will pay out the value of your bike pretty quickly to minimise hire/storage charges, they'll send you a letter stating this is on the caveat that if it's eventually decided you're at fault you'll have to repay this money (obviously you can ignore that as it's not your fault)

It'll possibly take a little longer to get paid out for helmet and leathers, to which  you'll have to pressure them.

If you claim any injuries that can take anything up to a couple of years to get paid

It seems annoying to yourself but just phone them every single day!

Anyway handling claim yourself with faulty party insurance company is risky business and potential can of worms. Not to mention the insurance hyenas will try to screw you.

Does not matter is it comp or tpft. The important bit is called Legal cover with your insurance company. And if you trust its good a company not some cowboys that will send the claim god knows where. And you contact them and ask them to handle the claim.

Or you get a proper accident management solicitor to handle that for you.

Don't get fooled by the legal cover premium val.

If, and this is an if, he is tpft, even paying for the extra legal cover, they will not help him, there was a recent thread about this, as well as several experiences of my own.

As you've mentioned he'd have to get an accident solicitor to handle it if the other parties insurance start being dicks about it, which is generally the case unfortunately!

Ask them for replacement bike asap. They give replacement bikes only if the 3rd party has admitted fault 100%.
