Crash = Sadness (CBF125) - JonBailey - 07-09-16

Hi all,

The Crash:
Monday morning I crashed my cbf125. Woman pulled out of her driveway form behind a car in front of me. The road conditions were wet so as I broke the bike went out from underneath me. The bike went into the Rear RHS of the car and I behind the car along the floor.

The Damage:
As I hit the floor my lower back was in so much pain (7.5/10). The bike has a bent frame, bent yoke, fairings both broken, front fairing/headlight unit broken, bent forks, bent disc, broken indicators, broken shifter.
Didn't get to see her car, I was on the floor, I hope the police got all the details I need.

The Aftermath:
I'm on a MCAMS loan bike until the insurance is sorted, I don't have a 125 to take me up until december (When I take my A2 Test), insurance paid for a new helmet (got a Shoei Qwest), and she said I am at fault for the accident.

And then yesterday my phone smashed on the floor, having a terrible week so far!

try to find any nearby houses or shops with CCTV. They may have caught the accident on film to shoot her story down.

Just looked on google maps, street view. None, it was more of a residential road than a high street.

Bollocks! If what you state is true then she should have taken better care to check that it was clear for her to pull out especially with the parked car in the way. Keep to your guns and don't let them get away with it, as they will argue till they're blue in the face so you have to do the same until they finally cave and come clean.

Had a similar thing happen to me but in a car and my insurance company screwed me over, I said it was their fault and my retarded insurance told them it was my fault and lost me 5 years no claims bonus. I put in several complaints but no comeback, warning to all "NEVER USE TESCO's CAR INSURANCE" they are crap and will screw you over and completely ignore you.

Tesco insurance = Direct Line at the moment but I hear that they are changing soon to another company.

If she pulled out of a house or side road into your path and you were on the major road I don't see how it could possibly be your fault unless you were driving recklessly and weren't in control of your bike but I seriously doubt you were doing that on a 125. I don't think she has a leg to stand on. If you aren't happy with how your insurance company is handling it think about getting a solicitor.

It was about 10 years ago and yes I believe back then they did use Direct Line but they had their own TESCO's office that was a go between and it was the TESCO's office that screwed me over as never had any issues using Direct Line directly.

(It was 2 years no claims bonus not 5 they lost me, sorry fat fingers on a small keyboard :lol )

I'm going through an accident management company called MCAMS, we recommend them to customers at work if they crash. I used them last time they done all the paperwork and contacting for me.

It was a wet day so I kept to the speed limit, she said to the police officer that was on the scene that she saw me and thought she had enough time to do, but a day later it's my fault. I told MCAMS this and they're contacting the police to get his statement. It was a busy road, being the South Circular at 8am an all!

I think the critical words here are that she saw you & decided she had enough time to pull out-error of judgement (or lack of). You were on the main road & she pulled into your path. And shes saying its YOUR FAULT! Hope you get a satisfactory result & glad you werent more badly hurt. Did you consult a doctor?

Lewisham hospital A+E for a checkup, said i was all good, I knew i was fine because the pain died down whilst on the floor for half an hour, but I wanted to get checked over just to be safe.

Glad you are not badly hurt BUT nail her.She is clearly in the wrong. She was pulling out of her drive way and admits she saw you!!!but thought she had time to pull away, clearly undue care and attention. One would have more sympathy for her if it had been a SDSU. How do you know you are okay ? pain could come back at a later date.Good luck.

glad you're ok now but see my answer in another post about insurance, if you're exiting a side road onto a main road the onus is on YOU and this is a similar scenario. Remember that you do not need to take your insurance solicitor, inform them that you're using your own.....contact "Sorry mate"
I have no ties to them but a workmate used them after he got hit and got a good wedge. Their ad says they're bike riders as well as lawyers so know the score.

Was she French? She may be used to the "Priorité à droite " where anyone joining a road has priority over them already on it.

Fortunately most of the old Frenchies are dying out now because they still pull out in front of Artics doing 90kmh and getting flattened.

Could be whiplash type injuries.

Could be aftershock symptoms, very common after a crash as adrenaline holds off a lot of pain and days later it wears off then the problems show up, get yourself to the doctors and get checked out again

Be wary of that hire bike...

check the terms and small print, as if it goes 50/50 or in her favour you may be liable to pay for the whole bike rental...and it won't be cheap
