Near miss (non-Fazer!) - Davebo - 05-08-13

Slightly off-topic as it involves cars but could so easily have been a bike.

I'm in a queue of traffic waiting at lights. I can see a car trying to pull out of a car park on the left. There is a gap.

On the right is a lane for turning right and their light is green. Matey boy in his warm hatch comes down at normal pace 30-ish and car on the left pulls out across both lanes.

Cue lots of squealing tyres and a slew across the lane. Narrow miss. Both parties off to Sketchleys.

Whose fault if there had been an accident ?

Couldn't bare to think what would have happened if either party was a bike.  :eek :o

Technically the car in the lane to turn right has priority and right of way, BUT ideally he should have slown down for the blind opening. The fact that he wasn't speeding probably saved the crash. In terms of fault, I think I'd put the majority of it with the car that pulled out for not being more cautious?

Fault would always lie with the vehicle coming onto the road, its not their right of way so caution must be exercised!

Quite so, but you can't get a clear view past parked cars when edging your cage out in traffic. Bit of a catch 22.

I could see it about to happen but nothing I could do.

Luckily no harm done on this occasion.

You can if you edge out just enough to see, plus anything coming will see the front of your car.  If you just drive out into traffic then accidents will happen.
