I got knocked off in 1996 so was subject to the old ruling. I'm a very happy man. That's brilliant news. Re: 20 year's, bang! Very lucky - nick crisp - 08-06-13 Jeez, I wish I got paid as much as solicitors for knowing f**k-all about my job!! Although my tale had a fairly happy ending, my solicitor sat back on her fat arse and let me do all the work, never said a word about the 2006 ruling. If it ever happens again, I'll be looking for someone with bike-specific knowledge to represent my case. Re: 20 year's, bang! Very lucky - bri h - 09-06-13 Glad your ok gel. I had a shunt a little while ago as most of you know and questiond keeping on riding. The insurancee company and repair shop managed to keep me of the road for over a month and by the time i got my bike back i was desperate to get back on it. I hope you feel the same in a short while Re: 20 year's, bang! I am also a qualified IAM rider and this is also backed up in the IAM manual. Where he failed was NO indication, Poor / No observation, as I was parallel with him when he turned. At the time I was wearing a IAM high vis top, had headlights on and a race can.My previous thou was written of in the same manor, but would you believe by a bent rear subframe(caused by the luggage system, which is why I dont have fitted all the time now). But same as you as was parallel to the driver who was stuck in traffic when the arse-hole turned right without looking or indicating, The only difference in road pos for me was there was plenty of room for me to filter between the cars and the center road markings. I was aware your above statement at the time, but as I had both options thought I would cut that argument from the get go. You mentioned having a race can, I know its only a fine for this but what did the Police/ins have to say..? Re: 20 year's, bang! Very lucky - gel - 10-06-13 HI All, Thank you for all your feedback, I have just had a call from the police and they are prosecuting the driver with "Undue". The copper said due to government ruling he will offering a training coarse that he has to pay for or Court. Nice Option. So he has to admit liability either way! I think I was lucky has a witness came forward and confirmed that he did not indicate and I was along side him when he turned across me. Anger is now starting to ebb away now. thanks again. Re: 20 year's, bang! Very lucky - nick crisp - 10-06-13 Result! Pleased for you, gel. :thumbup Re: 20 year's, bang! Very lucky - gel - 12-06-13 Spoke to the copper about the accident and said to him "that I normally filter down that road in 1st gear so that people can hear me as i have a race can on, but this time i didn't" He did bat an eye lid. I must be lucky I bounce well and copper did not do me for the race can. :rollin Re: 20 year's, bang! Very lucky - 1967fazer - 13-06-13 Good to hear you're ok and that things seem to be working out in your favour, definitely get out on a bike as soon as possible, it will keep you sane! On a slightly different line, you say were wearing a hi viz waistcoat or jacket? Doesn't really say much about the possible future ruling of having to wear hi viz clothing on a bike and how it will (in their eyes) cut down on motorcycle accidents, does it?? Re: 20 year's, bang! That said the french have fucked it off now, so the chances of it coming over here are slim. Re: 20 year's, bang! Very lucky - pitternator - 16-06-13 agreed. If someone simply does not look , then no amount of vis or careful driving means a damn. personally I try not to filter if I can except where I know a car cannot swerve or move , for this very reason.Usually this means in traffic queues at very low speeds or stationary . my survival technique is never get near a car !..overtake or hang back. Close proximity loses all our speed and acceleration advantages. We become prey to their indecision and stupidity...Cars are our mortal enemy ! :\ I do feel for commuters who probably have to filter come what may ....it is always then just going to be a matter of time b4 an incident will occur IMO. |
