Parked in a regular bay in Brighton for half an hour today and got a ticker for £70 - "Parking in a parking place or area not designated for that class of vehicle" - there is no sign anywhere saying cars only and I have used this spot for years to pop into the shops. There is bike bay now it seems 500 yards away but it was hidden by cars and i didn't see it as I was walking the other way.

Appeal or cough up - whatcha reckon?
It was at Elder Place if anyone knows the area - immediately behind Maplins (I needed some solder - dearest I've ever bought!) :o

Was it free parking or did you have to pay for the bay? If you paid then I would appeal the fine. You're are bound to get it reversed and if not it will at least delay payment due date by another 21 days or what ever it is these days ;)
-
Appeal, they are trying it on.
I bet you a pound to a pinch of shit, there is nothing in the national parking regs that says you can't park a bike in a normal parking bay. This kind of shit always gets my hackles up... fucking councils & parking companies and thier BS.
-
Its pay and display - but bikes don't have to in Brighton and Lewes. When I moved here I called and they confirmed this

Well there you go then, they're missing out on the money for one parking space! :rolleyes

Sorry, but according to Brighton's Parking Pages (https://www.brighton-hove.gov.uk/content/parking-and-travel/parking/pay-and-display-bays#bike)
Can I park a motorcycle in a pay and display bay?
You cannot park in a pay and display bay with a motorcycle.
We provide free motorcycle parking throughout the city and you should leave your motorcycle in one of these bays.
Brighton is full of free bike parking bays (http://www.brighton-hove.gov.uk/sites/brighton-hove.gov.uk/files/Brighton%20%26%20Hove%20Motorcycle%20Bays%2013-09-03.pdf)

send them back the ticket and suggest the warden needs retraining if he doesnt know the difference between a bike and a car

Unfortunately bang to rights after reading that, i think the main reason is that you can't "pay and display" with bikes, because there is simply nowhere to safely display your ticket.
You could try appealing but i don't reckon you'll win, especially as they offer free motorcycle parking anyway.
-
If its run by the council then I think you have to pay the fine (or appeal) if it's a private park then you can just pay there loss of income BUT in some private car parks (eg Morrisons) by parking you have agreed to their "fines" now wether this forms a legal contract I don't know,
-
It is in the public road so council parkies. If I had the web in my hand i would have known the rules - But I didn't and the council didn't bother informing me in any way such as a sign. i will probably end up paying but I've appealed and will make them work for it.
Chaz - beaten one of those in the past by sending them an offer of £1 (the cost of parking locally for an hour) and they went away. The 'fine' cannot be significantly more than the 'damages' or its not enforceable

Councils count on this type of apathy, you have nothing loose by appealing. Clearing the warden was just another jobsworth with a target bonus.

Let's not be blinkered here, it's in writing that you cannot park a bike in a pay and display car bay so they will simply refer to that.
What appeal can you make? I don't think that " I couldn't see the bike bay, because of parked cars" is going to wash very well?
And why was the warden being a "jobsworth"? He was just doing his job, it's not like it was personal.

Unless You cannot park a bike in a pay and display car bay was on signage I think Ginge has a good case to appeal. do you check the internet everytime you go into a town to check every small detail of the local bylaws
-
As darrsi says bang to rights. I'd still appeal though, pointing out the lack of signs and knowledge, bet they'll give you benefit of doubt.

No, obviously not, but in all the many years i've been riding i've never used a pay and display bay either, because there's nowhere to put a ticket.
There will always be a place marked out specifically for bikes in any town, even if it's maybe way too small and always full up.
One of the worst places i've ever tried parking in was Camden in London, my ex used to work in a shop not far from the market, and i needed to quickly drop something off to her so i buried my bike between two cars totally hidden away from sight down a side road as i knew i wouldn't be about long.
I was honestly back in about 8 minutes and sure enough they must've spotted me walking out of the road and taken aim with a ticket in hand.
Unfortunately for them they got one digit wrong on my number plate so i ignored it and nothing ever happened.
I agree he should appeal, as i said earlier, but i personally don't think it'll get him anywhere for this particular case.

I'm amazed a bus didn't just flatten your bike!

Always look on the Bright-on side of life, so the moral of this story is don't go to Brighton it's too expensive for motorcyclists, what were you doing in the Gay capital city anyway????????????????? :pc
-
Being the gay capital, there are plenty of places to park your bike for free. You need to be careful to don't park it in the wrong place though :pokefun
