Title: man down...
Post by: ogri48 on 25 August 2019, 08:00:55 pm

Me and Dave (Dynspud) had a bloody lovely day on the welsh mountain roads yesterday, him on his fazer, me on the xjr. Arranged to do it again today, but on the cruisers this time, and take a relaxed ride up to the reservoirs. This morning me and the gruppenfuhrer headed out to Chepstow then stopped for a coffee before heading deeper into wales, to meet Dave at the bike café just outside of Abergavenny. Thats when I got the text.."Had a big smash mate, bikes mullered. Sorry but cant make it.."
Couldn't get him on the phone(was tied up with the police and ambulance etc as it turned out) so we set of for Abergavenny, then tried again at the café. Finally got hold of him, and Dave being Dave, he said not to worry, he'd be fine etc, but we weren't having that so headed out to his gaff. Got there to find one very sore and rightly pissed off (think his bikes a write off ) feller.

Im so relieved my mate is ok but gutted for him. He fucking loved that bike to bits, and a two grand bike written off means fuck all to an insurance company, whilst at the same time an awful lot to us who run and look after them.
I know most of you dont know Dave, but hes one of lifes good uns, and a bloody good friend to have.
im just glad hes still here...

Sorry to hear Dave has been involved in what sounds like a very nasty incident, having met Dave & yourself at The Steel Horse on a couple of occasions i know what a sound bloke he is and meticulous with his bikes too.
Speedy recovery to Dave and maybe catch you at one of the Bike Nights later this year.

Hey Foccers

Just want to start by saying how touched I am by all your messages of support and goodwill.
It doesn't half restore your faith in biking when genuine bikers come together to support a fellow biker like this.

A BIG personal thank you to Paul for all his support, encouragement and help during a really difficult time.
You're one of the best mate and I am soooooooo glad I found you as a friend.

Just to let you all know I am healing really well; up and about walking with virtually no pain or limp and my dislocated right thumb is feeling a lot better with the swelling all but gone and flexibility returning by the hour.

My overriding feelings right now are that I am extremely lucky to be alive or not more seriously injured, coupled with being very angry at the drunken dickheads on the Fireblade who ploughed into me.
The rider walked away nearly unscathed having discharged himself from hospital the same day.
His only real injury, apparently, was a huge diagonal tear across his arse caused by the battery terminals he was sat on as their bike didn't have a seat fitted - they were sitting on the bare sub-frame!!!
The pillion, without a helmet, not so lucky as the last I heard he was in an induced coma for his head injuries and the police were still not sure whether he was going to pull through or not.

Gutted that my Virago is wrecked but I think it actually saved my life by being so solid and heavy and coming off best against the Fireblade in the "head to head" contest and flipping it into the air and over my flying body as I went over my handlebars.
I think I have been very, very lucky.

The rider might be feeling lucky too but it doesn't look too good for him in that the police are definitely going to prosecute, either for dangerous driving or something much worse depending on what happens to the guy in the coma.
They are also waiting for the results of blood tests for drink & drugs - they were both extremely pissed for sure and probably drugged up too.
Either way, he'll be going back to prison, where, apparently, he has already been before.

So, it's all better than it might have been and, once again, thank you one & all for your kind thoughts & support.
It means a lot and helps a great deal.

Dave  :faz :thumbup

Bloody lucky mate, glad you made it. Crazy story this ! These lowlife don’t deserve to walk this earth.

Dont push too quickly, theres likely some internal jarring taken place. So pleased you came out without serious injuries. I find it hard to have sympathy with the two others involved, seen similar now several times over my lifetime, most of them are just repeat offenders with no chance of making any useful contribution

Thanks both.
Have to agree with you that lowlifes they are and, quite frankly, we'd all be better off if they were out of the gene pool.

just glad your still here buddy. And as soon as your ready and able to hit the road (oooooof probably a bad choice of words my friend ;) :lol ) i'm your wingman. Your taking point every time now btw, as your body is obviously far better at deflecting stuff than my knackered old bones ;) ;) ;) ;) ;)

Everyones wishing this trash all kinds of bad shit but lets draw the line at death, whatever caused this accident, whether it's drugs or drink someones in a really bad way and I dare say when the riders' head is clear he'll be full of remorse for his mate/brother, whatever and for what he's done, Dave's ok thank god,I certainly am not a "do gooder" they are tossers and it all could have ended up worse than it did but it didn't,one of them's fucked and maybe deserves it but I wouldn't wish him dead.

I can hold my hand on my heart and say I am genuinely a "live & let live" kind of person.
I hold no malice or ill towards any other normal person who feels, and lives, the same way.
The important part here is "let live" and, I also believe, that these two won't stop doing this sort of thing until either they get killed or someone else does.
Better one, or both, of them than someone else, including me.

This reminds of an incident involving a fella at our work.  It’s probably about 15 years ago now.  He decided to come in for a Saturday OT shift.

He was driving his car to work and got hit at speed by a drugged up and drunk driver coming the other way.  He lost his life.  He was married with two young kids.  He was in a little Rover 25 or something, the loony was driving a Passat estate.  The loony escaped relatively unscathed.  Spent a couple of years behind bars and was released.

It’s just senseless.

Dave is a lucky man to be alive.  At the same time none of us knows what’s roond the corner.

The other guys, well what happens to them happens.  They made a choice, and they figured the rules didn’t apply to them.

I agree wholeheartedly.
And whilst Dave escaped reasonably well physically, I know from bitter experience that aint the end of it. Takes a while for the aftershocks to stop. Your just getting on with stuff and then BANG it hits you how things could have been very different. Looking forward to getting out on the bike with him again as soon as hes ready. And fixing the 1100. Sometimes fixing a bike you nearly got killed on kinda fixes you too. I Know that from experience too...

Cannot believe that!!! what a 22ct twat! and he gets off,I think that law is stupid anyway, they should tell the jury all the criminals previous IMO imagine how many have got off with low sentences or suspended because of it.

Title: Re: man down...
Post by: coffee on 31 August 2019, 11:44:43 pm
Apparently this rider who hit Dave had done the same thing before and walked away form it! and if it does go to court they won't be able to tell the jury that because you're incriminating the defendant and this might sway them.I think that law is fucking stupid, you could have someone with a load of previous and the jury are none the wiser. :wall
Title: Re: man down...
Post by: mtread on 01 September 2019, 12:18:44 am
But if the jury find him guilty, which they will, the judge will be aware of the previous convictions and will increase the sentence.

Title: Re: man down...
Post by: Fazerider on 01 September 2019, 08:55:31 am

Convictions are based on evidence of the crime, not on the basis that the accused had been convicted of something similar in the past. As mtread says, the sentence will take into account previous misdemeanours.
I've pm'd a mod, hopefully they'll will remove content here that could be used by the defence to claim prejudice.

Main thing is that Dynspud/Dave is alive with only minor injuries.   These things can impact in other ways though.  Fingers crossed in the longer term this nasty experience has little impact on your life Dave.

Meanwhile it’s probably best we don’t speculate on the outcome of any possible prosecution.  Anybody who has done jury service will know that as a Juror you must declare any personal knowledge or acquaintances relating to a case.  Jurors are instructed not to conduct any research into reports on the case over which they reside or into individuals on trial.

Obviously, jurors must be unbiased and unprejudiced.  Further there have been cases of unscrupulous individuals planting miss-information relating to individuals on trial on the internet in the hope that inquisitive and perhaps naive jurors may stumble across it.

So, it’s probably best if we don’t speculate here in public.

And if you are called for jury duty and turn to the internet to research your case understand that you are and can be found in contempt of court.  You might find yerself locked up :eek .

as you say VNA, main thing is Dave is ok (aside from having a freakishly large thumb twice the size of the other lol).we met up today on the fazers, which was his first time back on two wheels. And whilst it was as always great to see him, what was even better was watching him ride just as he used to...he hasn't lost his mojo whatsoever.  :) :) :) :) :) :) :) :)
